What is Mediation?

Mediation is a form of alternative dispute resolution where all interested parties meet at an agreed upon time/date/place to discuss the issues pending before the court, or if the parties are ready to settle the claim, they can negotiate a settlement and distill the agreement to writing. Mediators are neutral third parties employed to assist in the negotiations, good mediators challenge both sides to view the claim in a different light.

How Do I Know if Mediation Is Right for Me?

When the injured worker and the employer/carrier feel like they would either like to a) close their claim, or b) resolve the issues pending before the court – setting a certain date and time allows both sides of the “v” to finish up discovery and properly assess the monetary value of the claim.


Private mediators dedicate 100% of their time carefully listening to each side about the pros and cons of their case. State mediators may have more than one mediation going simultaneously. Although there are also times when you could be their only mediation, the parties may elect to hire a private mediator to be sure they can dedicate all their time to you.

What are the Fees for Mediation?

$275.00 per hour with a two hour minimum. $100.00 per hour hour of travel time for mediations outside of Orange, Osceola, and Seminole Counties.

Mediations canceled within 72 business hours of the scheduled time will incur a 1 hour charge. (Notice must be by fax or email.)

All mediation fees shall be paid by the Employer/Carrier/SA unless otherwise agreed to by the parties.
